AWNG’s Suit Against Sandi Group Reinstated

On February 15, 2013, the United States District Court for the District of Columbia granted a motion made by Aria Watan Nassery Group (AWNG) to reinstate its case against Washington-based Sandi Group.  The district court previously had dismissed AWNG’s case against Sandi Group because AWNG had been unable to quickly retain new counsel when its original counsel had terminated its representation.  The Lewis Firm filed a Rule 60 Motion for Relief from Judgment on AWNG’s behalf on January 12, 2012.

In its ruling, the district court acknowledged that AWNG had been slow in prosecuting its case, but granted the motion for the following reasons: (a) AWNG’s motion for relief was filed within ten days of the dismissal order; (b) granting the motion did not substantially prejudice Sandi Group; (c) AWNG’s failure to prosecute its case was more properly attributed to the conduct of its former counsel; (d) AWNG’s foreign location contributed to the time it required to obtain new counsel; and (e) AWNG made it clear that it is prepared to proceed with its case.  A copy of the Order can be found here.
